Terms for using the XpoBay website.

This website is operated by SMIQ Ltd, a company incorporated in the British Virgin Islands, trading as XpoBay (XpoBay, we, us or our).

By using this website, you agree to these terms. If you do not agree, you should not use the website.

You may use this website for lawful business and informational purposes. You must not:

Submitting an enquiry does not create a customer relationship, guarantee a demonstration or commit either party to proceed. Any proposal or service arrangement must be separately agreed.

These website terms do not replace any order form, Master Subscription Agreement, Data Processing Addendum, Service Level Agreement, statement of work or other agreement made between XpoBay and a customer.

Where a signed agreement applies, that agreement governs the XpoBay platform, services, support, fees, data processing and the customer's authorised users. If these website terms conflict with a signed customer agreement, the signed agreement prevails for that customer relationship.

To the fullest extent permitted by law, XpoBay is not liable for loss or damage arising solely from reliance on general website content, inability to access the website, or use of a third-party website linked from it.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited. Liability relating to contracted XpoBay services is governed by the applicable customer agreement.

Our Privacy Notice explains how we handle personal information collected through the website, direct enquiries and XpoBay services.

We may update these terms when the website, our business or legal requirements change. The revised terms apply from the date shown at the top of this page. Continued use of the website after an update means that the revised terms apply to that use.

These terms and any non-contractual obligations arising from them are governed by the laws of the Virgin Islands (British). Subject to any mandatory law that applies, the courts of the Virgin Islands (British) have exclusive jurisdiction over disputes relating to these website terms.
